TripShake - Terms of Service

Welcome to TripShake. TripShake is a Q&A website that connects travellers with locals and destination experts. The service is operated by TripShake Limited (also referred to as "the Company", or "TripShake").

By accessing or using any version of our website (also referred to as "www.tripshake.com" or "the Website", or "the Service"), you (also referred to as "the User") accept these Terms of Service.

Eligibility

You must be 13 years or older to use the Service, unless otherwise specified by the laws of your country. By accessing and using the Service, you represent and warrant that you are complying with this requirement.

Account data

You are solely responsible for any personal information you provide to TripShake while using the Service. Any information you provide will be treated in compliance with Privacy conditions specified in these Terms of Service.

You are solely responsible for anything that happens under your screen name: keep your password and screen name confidential at all times.

Site Content

All content of the Website, including but not limited to designs, text, graphics, pictures, information and any other file, are property of the Company, its Licencors or its Users. No content may be reproduced, modified, copied, built upon, distributed, republished or downloaded without explicit consent from the Company, with the exception of your own content that you posted on the site in compliance with these Terms of Service.

You are granted a limited, personal licence to access, use, download and print the Site Content for your own non-commercial, personal use, provided that you leave all copyright notices intact. You may not upload or reproduce any of the Site Content , with the exception of your own content, on any other platform, or store the information in databases of any kind.

User conduct

You must not use TripShake in violation of any local, national or international law.

By using the Service, you agree to abide to the following rules of conduct:

  1. you must not harass, abuse, threaten, intimidate other users;
  2. you must not impersonate any other person or user;
  3. you must not use TripShake for unlawful purposes, including those prohibited by any applicable local, national or international law;
  4. you must not use TripShake ways that could harm, damage ordisable the Service, or otherwise make the Service unavailable;
  5. you are solely responsible for any content that you upload on TripShake, including but not limited to data, information, text, screen names, trademarks, video, audio, sounds; you hereby indemnify the Company for any unauthorised use by you of any content posted on the Service;
  6. you may not upload, reproduce or submit any content that is covered by copyright, trademark, or any other exclusive proprietary right owned by anyone other than you, unless explicitly licensed by the owner to do so;
  7. you must not produce, distribute, and send any unsolicited personal communication (also referred to as "Spam") to other TripShake users ;
  8. you must not upload or transmit any computer virus, worm or any other piece of code of a destructive nature;
  9. you are solely responsible for the personal and sensitive data that you upload on TripShake. We strongly suggest that you avoid sharing with anyone more data than is necessary to use the Service.

The violation of any of these terms will result in immediate termination of your TripShake account. You also understand and agree that TripShake is not responsible for content posted by its Users and that the service is provided as-is and you use it at your own risk.

General conditions

We reserve the right to modify, terminate and resume the Service for any reason, at any time and without notice.

We reserve the right to refuse the service to anyone for any reason, at any time.

You understand and agree that we might, without any obligation, remove Content from that site that we determine to be offensive, threatening, unlawful, defamatory or otherwise not compliant with the Terms of Service. Such evaluations of the content are made at our sole discretion.

These terms are governed by the law of Englandand Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any claim you should ever have against TripShake.

In the event that any of these conditions should be found unlawful or unenforceable, such provisions, and those provisions only, shall be eliminated or limited, and, where possible, replaced with a valid condition that emobodies the intent of these Terms of Service, to guarantee that these Terms of Service remain in full force and effect.

The basic services provided by TripShake are free of charge. However, we reserve the right to introduce premium and advanced services that might be subject to individual charges. You understand and agree that while the basic service is free of charge, you are responsible to pay any data or network charges, including but not limited to charges for Internet connections, mobile data connections, SMS messagse, any other service that is needed to access TripShake.

TripShake may display and send to you targeted advertising, on or through the website. You understand and agree that by accepting these Terms of Service you accept (opt-in to) such advertising, in compliance with Privacy conditions contained in these Terms of Service.

Use of TripShake content on other media

TripShake might make it possible for you to export content from the Service to other websites, blogs or any other media. You may export any contents as authorised by TripShake, provided that you keep a link back to the Service.

Copyright

TripShake does not claim any ownership or intellectual property rights over Content that you upload to the Service.

However, by posting User Content to any part of the Service, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide licence, and the right to sublicence, to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. TripShake encourages the use of licenses such as Creative Commons and other progressive content licenses.

Any copyright claims should be sent to copyright@tripshake.com or by post, TripShake Ltd., 35 Vine Street, London (UK), EC2N 3AA, . All claims must be supported by the following information:

  1. a signature, physical or electronic, of the copyright owner or the person authorised to act on her/his/its behalf;
  2. a description of the work subject of the claim, complete with a website link (where possible) or any other information to make it reasonably possible for TripShake to identify such a work;
  3. your complete contact information, including address, phone number, e-mail.
  4. a statement undersigned by you that you believe in good faith that the copyrighted work is used without authorisation;
  5. a statement undersigned by you that the information contained in the notification is complete, accurate and true, and you are authorised to act on behalf of the copyright owner;
  6. a copy of an identification document, preferably a valid passport or, in absence of thereof, a national ID.

You understand and agree that we are under no obligation to remove copyrighted content we are unaware of, and we are not liable for the presence of such content on TripShake.

Limitation of Liability

The service is provided "as is", on a "as available" basis. We do not guarantee or make any representation regarding the use or the results of the use of the service. You understand and agree that the service might have software imperfections ("bugs"), and other issues affecting its availability to you. You agree and understand that TripShake is not responsible for any of these. TripShake does not guarantee that the Service will work on mobile phones or other devices, and/or in all geographical areas.

TripShake shall not be considered liable for any damage, direct or indirect, special or consequential, that arise out of the use of the Service or are a result of the use of the Service, to the maximum extent allowed by the law.

The sole remedy for any claims or dispute you might have concerning the Service or these Terms of Service is to discontinue using the service.

Modification of these Terms of Service

You understand and agree that TripShake is developing and will be developing new features throughout its existence. We thus reserve the right to alter, modify, add, delete parts of these Terms of Service at any time and without notice. If the modifications constitute, at our sole discretion, in good faith and using common sense, a material change to the Terms of Service, we will notify you by e-mail.

The sole remedy for any claims or dispute you might have concerning the new Terms of Service is to discontinue using the service.
